These Terms of Service (“Terms”) are a binding agreement between you and Benadep Beauty Co., Ltd. (“Benadep”, “we”, “our” or “us”). They govern your use of:
the Benadep website at benadep.com, including articles, the help center and the contact form;
the Benadep AI Workspace: Nail Art & Product AI, AI Video Creator, the Social Publisher and the text AI Agents;
BenaPro, our salon management software, including its AI Receptionist, Marketing Assistant and Report Assistant;
Workshops you book through the website.
Together we call these the “Services”. You accept these Terms when you tick the agreement box while creating an account, and again each time you use the Services. Our Privacy Policy explains how we handle your information and forms part of these Terms.
Important: if you do not agree with these Terms, do not create an account or use the Services. The Services do not include any product marketplace; purchases from a Benadep-affiliated store are governed by that store’s own terms.
2. Eligibility and Accounts
Professional use: the Services are built for nail salon owners, nail artists and beauty professionals and may be used only for business purposes. You must be at least 18 years old and able to enter into a binding contract.
One account per email: each email address can hold one account. If you sign up with Google, you sign in with Google from then on.
Accurate details: keep your name, contact details and salon profile accurate and up to date.
Security: you are responsible for your password, one-time codes and everything done under your account. Tell us at once if you believe your account has been compromised.
3. Workspaces and Teams
Your plan, credits and AI content belong to a workspace. The person who creates a workspace is its Owner and may invite team members as Admins or Members, up to the number of seats and brand locations included in the plan.
Invitations are sent by email, must be accepted by the invited address and expire after 7 days.
Admins may manage members but cannot remove or demote the Owner, and nobody may grant a role above their own.
The Owner is responsible for the workspace, including everything its members create, publish or spend, and for the payment of the plan.
If a downgrade leaves fewer seats or brand locations than are in use, you choose which stay active; nothing is deleted.
4. Plans, Free Trial, Credits and Payment
4.1 Plans
Paid plans are billed monthly or yearly in advance through our payment processor, Stripe. The price and limits of a plan are fixed when you buy it: a later price change applies only to new purchases and to your next voluntary plan change. Current plans, prices and limits are shown on the Pricing page.
4.2 Free trial
New customers may start a one-time free trial of 7 days without entering a card. The trial can be started once per person, by the workspace Owner, and its credits expire when the trial ends. When the trial ends, AI generation stops until you buy a paid plan; your history and downloads remain available. Add-on credits cannot be bought during the trial.
4.3 Credits and limits
Plans include a monthly allowance of images, video credits and AI Agent units. Each completed agent request uses one unit, each generated image uses one image, and a standard video uses one credit per 5 seconds; heavier video options are priced as shown in the app before you confirm.
Monthly allowances reset at each billing period and do not roll over.
When an allowance is used up, generation of that type stops until the next reset unless you buy an add-on pack or upgrade. Your monthly allowance is always used before add-on credits.
Add-on packs are available on paid plans only, are valid for 365 days from purchase unless the pack says otherwise, and are not refundable once bought.
Plans also set how many generations may run at the same time. We may apply fair-use rate limits to keep the Services available for everyone.
4.4 Payment
You authorise us and Stripe to charge your payment method for each billing period, add-on pack and quoted upgrade. Prices exclude taxes; where sales tax or VAT applies, it is added at checkout. If a payment fails, you keep full access until the end of the period you already paid for; after that, generation is paused while your history, downloads and the option to update your payment method stay available. Invoices are available from your billing page.
5. Plan Changes, Cancellation and Refunds
Upgrades: we quote the exact amount before you confirm. You pay the full difference between the two plans immediately, receive the extra credits at once, and your renewal date does not change.
Downgrades: take effect at the end of the current paid period. You keep the plan you paid for until then; no charge and no credit is made for the remaining days.
Cancellation: you may cancel from your billing page at any time. Cancellation takes effect at the end of the current paid period; nothing is deleted and you keep everything you already paid for until that date.
Plan changes between currencies or between monthly and yearly billing are not supported; cancel and subscribe again instead.
5.1 Refunds
Subscription payments are refundable on request if both conditions are met: the request reaches us within 14 days of the payment date, and no more than 10% of any allowance granted by that payment (images, video credits or AI Agent units) has been used or reserved. A refund cancels the plan immediately and removes the unused credits that payment granted; credits already used are never restored or re-billed. Add-on packs and payments outside these conditions are not refundable except where the law requires. To request a refund, email us at admin@benadep.com with your invoice number.
6. AI Tools: Your Content and the Results
6.1 Your content
You keep all rights to the prompts, images, videos, documents, logos and other content you provide (“Your Content”). You grant Benadep a worldwide, non-exclusive, royalty-free licence to store, process, transmit and display Your Content, and to send it to the AI providers named in our Privacy Policy, only as needed to provide the Services to you. You promise that you have the rights and permissions needed for Your Content, including permission from any client whose hands, face or work appears in a photo you upload.
6.2 Results
Subject to these Terms, Benadep assigns to you whatever rights it holds in the designs, images, videos, captions, replies and other outputs the AI tools create for you (“Results”), and you may use them for your business, including commercially. Please note:
AI outputs are not unique: other users who give similar inputs may receive similar Results, and you cannot claim exclusive rights against them.
The law on ownership of AI-generated work is still developing and varies by country; we cannot guarantee that Results are protectable by copyright or free of third-party claims.
Results can be inaccurate, incomplete or unsuitable. You are responsible for reviewing every Result before you rely on it, publish it, send it to a client or use it in advertising, and for complying with advertising, consumer-protection and professional-licensing rules that apply to your business.
6.3 How we may use Your Content and Results
We do not use Your Content or Results to train our own AI models and we do not show them to other customers. We keep them in your workspace so you can reuse, download and delete them, as described in the Privacy Policy.
7. Acceptable Use
You agree not to use the Services to:
create, upload or publish content that is unlawful, defamatory, sexually explicit, harassing, hateful or that promotes violence;
infringe anyone’s copyright, trademark, privacy or publicity rights, including by uploading a person’s photo without permission or copying another artist’s protected work;
make medical or therapeutic claims about products or services, claim a product is “FDA approved”, “100% safe” or “chemical-free”, or make other misleading claims. Our tools block or flag some of these claims automatically, but the responsibility for what you publish remains yours;
send messages, emails or reviews on behalf of someone who has not agreed to receive them. When an agent sends an email for you, you confirm that you have permission to email that recipient;
impersonate another person or business, or misrepresent Results as human-made where the law requires disclosure;
bypass rate limits, credit limits, security measures or access controls, share one account between businesses, resell the Services or use automated scripts against the app;
reverse-engineer, copy or build a competing service from the Services or their underlying models, prompts and workflows.
We may remove content or suspend features that break these rules, as described in Section 12.
8. Social Publishing
You may connect Facebook Pages, Instagram professional accounts, YouTube channels and TikTok accounts that you own or are authorised to manage. Connections are made through Benadep’s own apps or through our publishing partner, PostProxy, as shown in the app.
Everything you publish must comply with the rules of the network you publish to (Meta, Google/YouTube, TikTok). Those networks may reject, remove or restrict posts, and we cannot control their decisions.
Benadep schedules and delivers posts on a best-effort basis. We report the network’s response honestly, including a failed or restricted delivery, but we do not guarantee that a post is accepted, reaches an audience or stays online.
You may disconnect a network at any time from the Social Publisher; we then revoke our access and delete the stored token.
9. BenaPro Salon Software
BenaPro helps you run your salon; you remain the business owner. You are responsible for your service menu, pricing, deposits, booking policies, staff arrangements and for the accuracy of what you tell your clients.
You are the controller of your clients’ and staff’s information. You must have a lawful basis to store it, tell your clients how you use it and honour their requests. Benadep processes it only to provide BenaPro to you.
The AI Receptionist, Marketing Assistant and Report Assistant help you handle bookings, messages and reports. They act on your instructions and settings; you remain responsible for confirming appointments, for what is communicated to your clients and for reviewing reports before acting on them.
Payments you take from your clients are between you and your clients and your own payment provider.
10. Workshops
Workshop details, dates, prices and capacity are shown on each workshop page. A booking is confirmed by us once any fee is paid as instructed on the page or in your booking email; unconfirmed bookings may be released if capacity is reached.
You may cancel a booking from your profile at any time before the workshop starts. Whether a paid fee is refunded depends on the cancellation terms stated for that workshop.
If we cancel or reschedule a workshop, we will notify every booked participant by email and refund any fee already paid for a cancelled workshop.
Workshop content is for your own learning; recording, redistributing or reselling it is not allowed without our written permission.
11. Benadep’s Intellectual Property
The Services, including the software, design, templates, workflows, agent skills, house prompts, text, graphics and trademarks, belong to Benadep or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your business while your account is in good standing. Except for Your Content and Results, nothing in these Terms transfers any rights in the Services to you. Feedback you give us may be used without obligation to you.
12. Suspension and Termination
By you: you can delete your account at any time from Profile → Delete Account, after confirming your password or a one-time code. Deletion is immediate and cannot be undone; the Privacy Policy describes what is removed. Cancel any upcoming workshop booking first. Deleting your account does not refund a subscription period already paid for.
By us: we may suspend AI generation for a workspace, block an account or remove content if you breach these Terms, if a payment remains unpaid, if we are required to by law or if your use threatens the security or availability of the Services. Unless we must act immediately, we will tell you by email why we acted and how to resolve it. If you believe we acted in error, contact us at admin@benadep.com.
Effect: when your account ends, your licence to use the Services ends. Sections 5.1, 6, 11 and 13 to 17 survive termination.
13. Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, Benadep disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. In particular, we do not warrant that Results are accurate, original or suitable for any purpose, that third-party AI providers or social networks will be available, or that the Services will be uninterrupted or error-free. Nothing in these Terms limits rights that consumer law gives you and that cannot be excluded.
14. Limitation of Liability
To the fullest extent permitted by law, Benadep and its officers, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Services, even if advised of the possibility. Our total liability for all claims arising from or related to the Services in any 12-month period is limited to the amount you paid us for the Services in the 12 months before the event giving rise to the claim, or USD 100 if you paid nothing.
15. Indemnification
You will defend and indemnify Benadep against claims, damages and reasonable costs arising from Your Content, your use of Results, your dealings with your own clients, your social media accounts, or your breach of these Terms or of any law.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Before starting any legal action, you and Benadep agree to try to resolve the dispute informally: send a written description of the issue to admin@benadep.com, and we will do the same to your account email; both sides will negotiate in good faith for 30 days. If the dispute is not resolved, it will be brought exclusively in the state or federal courts located in Gwinnett County, Georgia, and both sides consent to their jurisdiction. Either side may seek injunctive relief to protect its intellectual property in any competent court.
17. Changes to These Terms
We may update these Terms as the Services change. We will post the new version with a new effective date and, for material changes, notify you by email or inside the app at least 14 days before they take effect. Continuing to use the Services after that date means you accept the updated Terms. If you do not agree, cancel your plan before the new Terms take effect.
18. General
These Terms and the Privacy Policy are the entire agreement between you and Benadep about the Services. If any part is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor of our business. Notices to you will be sent to your account email.
